This End User License Agreement ("EULA") governs your use of the mobile applications provided by Town4kids, available through the App Store. By downloading or using any Town4kids App, you agree to comply with the terms outlined in this EULA.
The license to use each application ("Licensed Application") is granted to you, not sold, and is subject to your acceptance of and compliance with this EULA. The licensing rights for the app are provided by Town4kids Pte Ltd ("Licensor") for Town4kids apps, and by Apple Inc. for apps distributed through the App Store.
Licensor grants you a non-transferable license to use the Licensed Application on Apple-branded devices that you own or control, in accordance with the App Store's Usage Rules. This license is solely for personal, non-commercial use.You may not:
- Distribute the app or make it available over a network where it could be used by multiple devices at once.
- Transfer, sublicense, or sell the Licensed Application.
- Remove or bypass security features, reverse-engineer, disassemble, or attempt to derive the source code of the app (except where permitted by law).
- Copy or modify the app, except as allowed under this license.
If you sell or transfer your Apple device, you must delete the Licensed Application from it before doing so.
You agree that Licensor may collect and use technical data related to your device, system, and app usage to provide software updates, product support, and other related services. This data will be anonymized and used solely to improve products and services.
If you subscribe to any auto-renewing subscription within the app, you will be charged periodically until you cancel the subscription. To stop automatic renewals, go to the Settings app on your Apple device and cancel the subscription before the renewal date. All payments made are non-refundable, and you will retain access to the services until the end of the current billing period.
All financial transactions related to in-app purchases are processed by third-party payment processors. You should review their privacy policies and terms of service. Licensor is not responsible for the actions or failures of these third-party services, including payment processing failures.
All payments are non-refundable. There are no refunds or credits for partially used subscription periods. If you cancel your subscription, you will retain access until the end of the current billing cycle.
This EULA remains in effect until terminated by either you or Licensor. Your license to use the Licensed Application will terminate automatically if you fail to comply with any of the terms of this EULA.
The Licensed Application may link to third-party services ("External Services"). Licensor is not responsible for the content, accuracy, or availability of these services. You use these External Services at your own risk and agree not to misuse them. Data provided by the application or third-party services is for informational purposes only and is not guaranteed. Licensor may change, suspend, or restrict access to these services at any time without notice.
THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Licensor does not guarantee that the application will meet your requirements or that it will be error-free. If the app proves defective, you are responsible for any necessary repairs or corrections.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall Licensor’s liability exceed $50.00.
You may not export or re-export the Licensed Application except as authorized by U.S. law and the laws of the jurisdiction in which you obtained the app. The Licensed Application may not be exported to any U.S.-embargoed countries or to individuals or entities on U.S. government restricted lists. By using the app, you confirm that you are not located in such countries or on these lists.
The Licensed Application and related documentation are considered "Commercial Items" as defined by U.S. law, and are licensed to U.S. Government end users only as commercial items, with rights limited to those granted to all other end users under this EULA.
This Agreement shall be governed by the laws of the State of California, U.S.A., excluding its conflicts of law provisions. For non-U.S. residents, any disputes will be governed by local laws as set forth in the applicable jurisdiction.
- This EULA constitutes the entire agreement between you and Licensor.
- Any failure to enforce any provision of this EULA will not be deemed a waiver of such provision.
- If any part of this agreement is found invalid, the remainder will remain in effect.
By using the Licensed Application, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA.
